A rare Superior Court move to overturn a jury verdict has been upheld by the Delaware Supreme Court, sending a long-running dispute over insurance coverage back for another trial.
The opinion by Chief Justice Collins J. Seitz Jr. handed down on Tuesday gives Conduent State Healthcare a second chance to convince a jury AIG Specialty Insurance and two additional insurers were wrong in declining to cover Conduent in a now-settled Medicaid fraud-related lawsuit.
