Well thought of and planned policies can crumble, like a sandcastle, at first hit of waves, if there isn’t a strong administration in place to implement them.

Membership in a Public Service Commission is a position of significant constitutional trust and responsibility. Any conduct on part of its Members that appears subjective or raises suspicion has potential to erode faith and undermine public confidence. Thus, it is imperative for a Public Service Commission to discharge its duties with utmost impartiality, free from any extraneous and suspect influences that could compromise its integrity.

Ram Ashray Yadav (Dr.), Chairman, Bihar Public Service Commission, (2000) 4 SCC 309 and Chhattisgarh Public Service Commission, (2009) 8 SCC 41 had clearly held, if facts and evidence on record do not show, a Chairman or a Member of a Public Service Commission was directly responsible for irregularities alleged in charges, then question of them being guilty of ‘misbehaviour’ under Article 317(1) would not arise.

It is difficult to see how allegation of ‘misbehaviour’ on part of Ms. Mepung Tadar Bage has been proved.
