According to NRS §41.035(1), “An award for damages in an action… against a present or former officer or employee of the State or any political subdivision… may not exceed the sum of $200,000[.]” In other words, in cases involving public agencies or government agencies, the government has passed laws to limit the compensation those affected by their negligence can earn in personal injury claims against them.

According to NRS §41A.035(1), “In an action for injury or death against a provider of health care based upon professional negligence… the amount of noneconomic damages awarded in such an action must not exceed $350,000.” However, as of January 1, 2024, that limit has increased $80,000 on the first day of the year, and will continue to do so until after January 1, 2028. That means the limit currently sits at $510,000, and will slowly increase to $750,000 by the start of 2028.
