A Massachusetts federal judge allowed an attorney and former employee of the Revere City Solicitor’s Office to proceed with her unlawful discrimination and retaliation lawsuit after denying the defendants’ claims of court procedural errors.
In a memorandum and order filed on Feb. 12, U.S. District Judge Indira Talwani denied the the city of Revere and its city solicitor Paul Capizzi’s move for a partial dismissal under Rule 12(b)(6) and a complete dismissal under Rule 41(b) of the Federal Rules of Civil Procedure.
Plaintiff Cheryl A. Leon-McCormick sued the city and city solicitor in July 2024, listing nine causes of action. She claimed both defendants committed gender discrimination, retaliation and privacy violations along with denying her equal pay and violating federal labor laws. She also alleged one cause of action for conversion against Capizzi.
