Med Mal Defense Win Stands as State Appeals Court Rejects Arguments Over Blocked Cross-Examination


Two doctors accused of medical malpractice have successfully defended their trial win, after a state appellate court rejected the plaintiff’s argument that she should have been able to cross-examine a defense expert regarding the doctors’ decision to switch antiseptic medications after the plaintiff’s treatment.

On Thursday, a unanimous three-judge panel of the Appellate Court of Illinois First District found a causation expert’s testimony sufficient to establish that two Chicago-area pain specialists did not cause a woman’s spinal infection when they administered an ineffective antiseptic for a back procedure.
